Our services are provided with reasonable care, but service interruptions may occur for reasons beyond our control. Clients agree that Kohinoor Hosting shall not be liable for damages caused by circumstances beyond our direct control.
2. Account Responsibility
Clients are responsible for all actions conducted through their accounts. You agree to:

Maintain confidentiality of login credentials.

Use services lawfully and responsibly.

Adhere to our Fair Usage Policies, including limitations on CPU, RAM, disk space, email sending, and bandwidth.
Fair Usage Policy for $1 “Unlimited” Hosting Plan:

CPU: 100% per account (as allocated by CloudLinux/LVE)

RAM: 2GB per account
-
Entry Processes: 25 per account

Disk Space & Bandwidth: Soft limits apply (e.g., 100–200GB disk, 1TB/month bandwidth)

Emails: 300 emails/hour per cPanel account
Accounts violating these limits may be suspended or terminated to protect server stability.
3. Indemnification
You agree to defend, indemnify, and hold harmless Kohinoor Hosting, its employees, affiliates, and agents from any claims, damages, liabilities, costs, or expenses (including attorney fees) arising from:

Your use of our services

Content you host, transmit, or distribute

Violation of laws, copyrights, or third-party rights
Kohinoor Hosting reserves the right to remove any content or intervene on accounts that violate policies.
4. Billing & Payments

Services are billed monthly, quarterly, semi-annually, or annually depending on plan.

Refunds are subject to a 7-day money-back guarantee from the initial sign-up date, except for: domain registration/transfer fees, servers, or crypto/alternative payments.

Accepted payment methods: Visa, Mastercard, American Express, Discover, PayPal, Alipay, WeChat Pay, Cryptocurrency.

Services auto-renew unless canceled prior to the next billing cycle.

Non-payment may result in suspension after 5 days and termination after 30 days.
5. Uptime & Service Guarantee

We strive for 99% uptime, but certain events may impact service:

Scheduled maintenance

Hardware failures

DDoS attacks exceeding mitigation capacity

Clients may request account credits for downtime via support ticket. Kohinoor Hosting mitigates DDoS attacks up to available thresholds but cannot guarantee protection from all attack types.
6. Limitation of Liability

Kohinoor Hosting is not liable for:

Loss of data or content

Service interruptions beyond our control

Indirect, incidental, or consequential damages

Our liability for negligence is limited to fees paid for the service during the affected period.
7. Backups

Clients are responsible for maintaining their own backups.

We recommend external storage solutions such as Wasabi, Amazon S3, or similar.

Automated backups may be provided, but Kohinoor Hosting is not liable for lost data.
8. Security

Kohinoor Hosting applies regular security patches to servers and services.

Clients are responsible for the security of their websites, scripts, and passwords.

Any compromise caused by client negligence is the client’s responsibility.
9. Termination & Suspension
Kohinoor Hosting reserves the right to suspend or terminate accounts for:

Violation of TOS, Fair Usage Policy, or laws

Non-payment
-
Abuse of system resources
Termination may occur without notice, at our sole discretion.
10. Disclaimer
Kohinoor Hosting cannot be held liable for:

System downtime, crashes, or data loss

Predicted profits or income
-
Issues arising from third-party software, resold services, or content hosted by clients
Accounts may be suspended or removed without refund if TOS or policies are violated.
11. Changes to Terms
Kohinoor Hosting may revise these Terms at any time. Changes take effect upon posting on our website. Continued use constitutes acceptance of updated terms.
